    Escritura de compra y venta de inmuebles en Portugal tiene nuevas reglas

    The new rules that require the disclosure of the means of payment of Real Estate in the deed.
    The new rules of the Scriptures of Purchase and Sale of Real Estate have just been published in Diário da República.
    From November it is mandatory to identify all means of payment through which the properties are traded.

    The aim is to enable the authorities to track the money and reduce the risks of simulated businesses, which in a sector such as Real Estate, which is more likely to escape and money laundering.
    This created the Central Registry of the Beneficiary (RCBE) and
    is made through amendments to the Land Registry Code and the Notary Code.
     
    For example:
    If a property is purchased and paid by check, it is mandatory to indicate the check number and the bank.
    If the payment is the bank transfer, then the bank and the bank account number will have to be identified. These are elements that are not currently included in the scriptures.
    When the payment is in cash it is also necessary to indicate the currency used, however, there is a limit of 3,000 euros for cash payments.
     
    These rules, which form part of the comprehensive package transposing the directive on the prevention of money laundering and terrorist financing, come into force in 90 days in mid-November.
